Terms of use

These terms are an agreement between you and Belmont General LLC, trading as Belmont Labs ("we", "us"), covering the KueTap app, the website at kuetap.com, the card pages served from tap.kuetap.com, and any KueTap stickers we supply. KueTap is a TowFi product. By using any of it, you accept these terms. If you do not accept them, do not use KueTap.

1. What KueTap does

KueTap lets you build a digital business card, program an NFC sticker that points at it, and hand that sticker to people. When somebody taps it, your card opens on their phone and they can save you as a contact.

The sticker holds only a web address. Your card content lives on our server, which is why editing it updates every sticker you have already given out.

2. Your account

KueTap uses your TowFi account. You are responsible for keeping your login secure and for everything done through it. Tell us promptly if you think someone else has access.

You must be at least 13 to use KueTap, and old enough to enter a contract where you live. If you are using it for a company, you confirm you are authorised to act for that company.

3. Your content, and the fact that it is public

Everything you put on a card is public. There is no password on a card page. Anyone holding your sticker, and anyone sent its link, can read it and save it. Treat a card as a printed business card: assume it can end up anywhere.

You keep ownership of what you upload. You grant us a non-exclusive, worldwide, royalty-free licence to store, resize, reformat, and publish it, solely to run KueTap. That licence ends when you delete the content, apart from copies already saved by people who tapped your card, which we cannot reach.

You are responsible for what you put on a card. By uploading, you confirm you have the right to use it — including any photograph, logo, or trade mark — and that publishing it breaks no law and no one else's rights.

4. What you must not do

You may not use KueTap to:

Impersonate anyone. Do not make a card presenting yourself as another person, or as a company you are not authorised to represent. This is the rule we enforce most strictly — a business card is a claim about identity, and a false one causes real harm.
Publish someone else's personal details without their permission.
Publish unlawful, fraudulent, deceptive, harassing, hateful, or obscene material.
Link to malware, phishing pages, or anything designed to deceive.
Advertise a business you are not entitled to advertise.
Probe, scan, or attempt to enumerate tag addresses; circumvent rate limits; or try to access another account's cards, stickers, or tap records.
Resell, sublicense, or white-label KueTap without a written agreement with us.
Place a sticker on property that is not yours or where you have no permission.

We may remove content, revoke a tag, or suspend an account that breaks these rules, in some cases without notice where the risk is serious.

5. Stickers and NFC hardware

NFC stickers are physical objects and they fail in physical ways. They can be peeled off, damaged, covered by metal or a thick case, or simply lost.

Once a sticker is programmed and locked, its chip cannot be rewritten. If a sticker leaves your control, revoke it in the app — its page and contact file stop working immediately, everywhere, without needing the tag back. We cannot recover a lost sticker, and we cannot delete a contact already saved into someone's phone.

Not every phone reads NFC, and reader placement differs between devices. We do not warrant that any particular phone will read any particular sticker.

6. Availability

We aim to keep KueTap running but we do not guarantee it. The service may be unavailable for maintenance, upgrades, or reasons outside our control. Because a card page is served from our infrastructure, an outage means your stickers will not resolve while it lasts.

We may change, suspend, or discontinue any part of KueTap. If we discontinue it altogether we will give reasonable notice and a way to export your data.

7. Fees

Where any part of KueTap is offered for a fee, the price and billing terms will be shown before you are charged. Purchases made through the App Store are also governed by Apple's terms, and refunds for those are handled by Apple.

8. Our intellectual property

The KueTap name, the KueTap and TowFi marks, the software, and the design of the app and card pages belong to us. These terms give you a limited, revocable, non-transferable right to use KueTap as intended, and nothing more.

9. Third parties

KueTap depends on services we do not control, including Apple, our hosting provider, and mobile networks. We are not responsible for their acts or omissions. Links on a card page lead to sites we do not operate and do not endorse.

10. No warranty

KueTap is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any card will render identically on every device.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or lost opportunities, arising from your use of KueTap — including business lost because a sticker failed, a card did not load, or a contact did not save.

Our total liability for any claim relating to KueTap is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you.

12. Indemnity

You agree to indemnify us against claims, losses, and reasonable legal costs arising from your card content, your use of KueTap, or your breach of these terms — including any claim that something you published infringed another party's rights.

13. Ending it

You can stop using KueTap and delete your account at any time. We may suspend or end your access if you break these terms, or if we are required to by law.

On termination your cards stop resolving and your stickers become inert. Sections covering your content licence, intellectual property, disclaimers, liability, and indemnity survive.

14. Governing law

These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located there, and you consent to that jurisdiction.

15. Changes

We may update these terms. We will change the date above and, for material changes, notify you in the app. Continuing to use KueTap after a change means you accept the new terms.

16. Everything else

If any provision is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These terms, with the privacy policy, are the entire agreement between us about KueTap. You may not assign them; we may assign them to a successor.
